Siman 496 – Yom Tov Shayni

9. In the Diaspora we make two days of Yom Tov out of doubt. Nowadays we have no doubt about the calendar dates. Nevertheless, Chazal instituted to keep two days lest situations in this dire exile change and the exact dates become forgotten. (ShA 1 – MB 1

10. Everything that is forbidden on the first days of Yom Tov is forbidden on the second day. This includes issurim d’rabbonon as well – such as techumim., shvus, and amira l’akum. Some poskim hold that Bais Din should punish a person who belittles Yom Tov Shayni more than Yom Tov Rishon. (ShA 1 – MB 2)

11. There are two exceptions to the stringency of Yom Tov Shayni:
    • On Yom Tov Shayni you are allowed to deal with the honor of the dead.
    • On Yom Tov Shayni you are allowed to take medicine to relieve an ache – even if it does not affect your whole body. (ShA 2 – MB 5)

12. On Yom Tov Shayni you aren’t allowed to do a melacha d’oraisa for someone who’s entire body is aching. You may instruct a goy to do it for him even on Shabbos. (Rama 2 – ShaH 10)

13. Bnay Eretz Yisroel do not keep Yom Tov Shayni. If they visit a town in Chutz L’oretz for Yom Tov, they must keep the minhag of the local Jews and observe Yom Tov Shayni. If there are no local Jews or the Ben Eretz Yisroel stays outside the techoom, he is not bound by the minhag of Yom Tov Shayni. (ShA 3 – MB 10)

14. The Ben Eretz Yisroel must keep all of the chumros of Yom Tov Shayni even in private including wearing Tom Tov Clothes. However, he is still bound by the chumros of Eretz Yisroel. Therefore he must daaven a weekday Shemoneh Esray and don tefillin in private. And when Yom Tov Shayni falls on Erev Shabbos the Ben Eretz Yisroel need not arrange an Eruv Tavshillin since his Shabbos preparations are not construed as hachona. (MB 9, 13)

15. Lets say a Ben Eretz Yisroel was in the town before Yom Tov but for Yom Tov itself he left the techoom. If he plans to return to Eretz Yisroel he is not bound by the chumros of Yom Tov Shayni. (MB 10)

16. If he plans to stay in Chutz L’oretz he is bound by Yom Tov Shayni even in the wilderness. However if he never ever came to a town in Chutz L’oretz (i.e. he moved directly to a wilderness) he is still not yet bound. (ShA 3 – MB 12)

17. A Ben Chutz L’oretz who comes to visit Eretz Yisroel for Yom Tov must still keep the chumros of Yom Tov Shayni and daaven Yom Tovdik privately. (MB 13)

18. If a Ben Chutz L’oretz intends on staying in Eretz Yisroel, he immediately takes on the minhagim of Eretz Yisroel. (MB 13)

19. Let’s say you move to Chutz L’oretz or to Eretz Yisroel with your family intending to make money in the new location. You are bound by the minhagim of the new location even though your intention is to move back. (MB 13)

20. If your intention is to stay permanently in the new location you are bound by the new minhagim even though your wife remains in the first location. (MB 13)
