הChelek 5

  1. Chol Hamoed is a time when everyone is off from work and has flexibility. Therefore Chazal permitted community members to schedule C.H. for combined efforts to fix things for the sake of the public, even if it takes excessive exertion. However, there are two restrictions : 1 – They must be benefiting people’s bodies like roads, mikvaos, and bathhouses (excluding building synagogues). 2 – It must not require professional work. (ShA , MB , )
  1. Professional work is permitted for the public only if they will benefit from it on the Moed, like expert mikva repairs that will be finished on C.H. Another example of this is brought in Shaaray Teshuva – constructing extra shul benches for a crowd expected to come for Simchas Torah. (ShA – ShaH – ShaT*)
  1. All public workers may be paid. (BeH “tzorchay”)
  1. If there is an entity in charge of public works, the project may not be scheduled on C.H. (MB )
  1. An argument could be made to allow gentile contractors to continue building a synagogue on C.H. That is, if they interrupt their momentum and take a different job, they may never get back to building the synagogue and there will be financial loss. Another leniency would be if the gentiles finish the building of the shul so that we could daaven in it on Yom Tov. (MB – ShaH 10)
