# Siman 548 – Mourning on C.H.

וChelek 6

1. If burial takes place on Yom Tov or C.H., the restrictions of the first seven days of mourning do not apply. Begin counting the *shiva* only after the festival. However, the restrictions of the *shloshim* **do** apply (e.g. haircuts). Therefore the shloshim are counted from the day of the burial. (ShA - MB , )

1. The seven day candle can be lit immediately following the burial. Just be sure not to light it in the dining area – it might trigger a spontaneous eulogy. This candle may not be lit on Yom Tov. (MB )

1. In places that observe a second day of Yom Tov, the second day of Yom Tov counts as the first day of *shiva* even though there is no mourning conduct. From then on, count only six more days. (ShA )

1. If the burial took place on Rosh Hashana (whether the first or second day), the second day counts as the first day of *shiva*. (MB )

1. Simchas Hareggel of Yom Tov Sheni overrides mourning, just like Yom Tov Rishon. (Rama )

1. Someone who buries a relative on the Reggel must conduct himself with private aspects of mourning. This includes refraining from washing in hot water and marital relations. L’chatchila, he should not receive an aliyah to the Torah. (ShA - MB )

1. Even though there is no availus on the Moed, there is aneenus. Therefore, if his relative died on C.H., he is forbidden to do anything that an onen is forbidden to do. However, if the death was on Yom Tov itself, and the burial will not be until after Yom Tov, he is not an onen on Yom Tov. (ShA )

1. Immediately upon burial, even on the Moed, people should be involved in comforting the relatives. Thus begins seven days of comforting which will end before *shiva.* (ShA )

1. If someone died and the relatives conducted at least one aspect of mourning before the Reggel - even for a moment, the *shiva* is cut short with the commencement of the Reggel. However, since the laws of *shloshim* **do** apply during the Reggel (e.g. no wearing newly ironed clothing, and there will not be a hetter of laundering or haircutting), those days count towards the 30 days of availus. (ShA - MB , )

1. If the full *shiva* was already observed, the Reggel will cut short the *shloshim.* This applies, even if the mourners “got up” on erev Yom Tov. It’s because as long as the laws of *shloshim* begin before Yom Tov, the remainder gets cancelled with the commencement of Yom Tov. The mourner will be able to take a haircut, launder, and to have a hot bath on erev Yom Tov close to evening. (ShA - MB - BeH “umutar”)

1. Erev Pesach cuts short *shloshim slightly* differently. Since after chatzos is a Yom Tov of slaughtering the Korban Pesach, bathing in hot water and laundering become permitted right away. Hair cutting is allowed even before chatzos since afterwards it will not be permitted. (MB )

1. If the seventh day of *shiva* falls out on Shabbos, and Yom Tov will be Saturday night - he will be allowed to take a haircut during C.H. (ShA )

1. When a person is mourning a parent, he may not take a haircut after *shloshim* until his friends tell him he must. If his friends told him for the first time to take a haircut on C.H., he is allowed to take a haircut immediately since he was not able to do it before Yom Tov. (ShA - BaH 11)

1. In the case that the Reggel cuts short *shiva -* on erev Yom Tov, laundry can be done close to evening, but do not wear the clothes until Yom Tov starts. After daavening Mincha, one can be lenient and bathe (at least in cold water) in honor of Yom Tov. This leniency certainly extends to C.H. All other laws of mourning, including the prohibition of sitting on chairs and wearing shoes, apply until nightfall. (ShA - MB , , )

1. Rosh Hashanah and Yom Kippur are considered like Reggalim to cut short availus. (ShA )

1. As long as one hour of mourning was observed before the onset of Pesach, it counts as seven days. Then, the eight days of Pesach make it 15 days. There will only be 15 days after Pesach required to finish *shloshim*. (ShA )

1. As long as one hour of morning was observed before the onset of Shavuos, it counts as seven days. The first day of Shavuos counts for another seven days (as it was for offerings in the Bais Hamikdosh). So the second day of Shavuos counts as the 15th day of mourning. That leaves 15 more days to finish *shloshom*. (ShA )

1. As long as one hour of mourning was observed before the onset of Rosh Hashanah, it cancels *shiva.* Eight days later, Yom Kippur will cancel the rest of *shloshim*. A haircut is allowed on erev Yom Kippur. (ShA )

1. As long as one hour of mourning was observed before the onset of Yom Kippur, it cancels *shiva*. Four days later, Sukos will cancel *shloshim*. A haircut is allowed on erev Sukos (and certainly baths and laundry). (ShA - MB )

1. As. long as one hour of mourning was observed before the onset of Sukos, it counts as *shiva.* Seven days later, Shemini Atzerres counts for another seven. That's 21 so far. Simchas Torah will be day 22 and there are only eight days remaining to finish *shloshim*. (ShA )

1. A woman who gave birth and other sick people are not able to conduct the mourning, and are considered oness. Nevertheless, if a Reggel commences during *shiva, shiva* is canceled. The same applies if a Reggel begins during *shloshim*. (MB )
